TERMS OF SERVICE

1. Agreement to Terms

By accessing or using GIB ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

GIB is a platform that allows users to create donation pages for receiving cryptocurrency payments. The Service is provided "as is" and we reserve the right to modify or discontinue the Service at any time.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you:

  • Are at least 18 years of age
  • Have the legal capacity to enter into these Terms
  • Will comply with all applicable laws and regulations in your use of the Service
  • Are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country

3. Account Registration and Security

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account
  • Not share your account with others or create multiple accounts

4. Cryptocurrency Wallets and Transactions

Self-Custody: GIB does not custody, control, or have access to your cryptocurrency wallets or funds. You are solely responsible for:

  • Maintaining control of your private keys and wallet addresses
  • Ensuring the accuracy of wallet addresses you provide
  • Understanding the risks associated with cryptocurrency transactions
  • Complying with tax obligations related to cryptocurrency donations

No Reversals: Cryptocurrency transactions are generally irreversible. We cannot reverse, cancel, or refund any cryptocurrency transactions made to addresses you provide.

Verification: You are responsible for verifying all wallet addresses before adding them to your profile. GIB performs basic format validation but does not verify wallet ownership or address accuracy.

5. Acceptable Use

You agree not to use the Service to:

  • Engage in any illegal activities or promote illegal conduct
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or harvest personal information of other users
  • Transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the Service or servers
  • Violate any applicable laws or regulations
  • Use the Service for money laundering or terrorist financing
  • Engage in fraudulent or deceptive practices
  • Infringe on intellectual property rights of others

6. User Content

You retain ownership of any content you post on your profile, including text, images, and links ("User Content"). By posting User Content, you grant GIB a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content as necessary to provide the Service.

You represent and warrant that your User Content does not violate any third-party rights or applicable laws. We reserve the right to remove any User Content that violates these Terms.

7. Subscriptions and Payments

Free and Paid Plans: GIB offers both free and paid subscription plans. Paid subscriptions are processed through Stripe and are subject to the pricing displayed at the time of purchase.

Billing: Subscriptions automatically renew unless cancelled before the renewal date. You authorize us to charge your payment method for recurring subscription fees.

Cancellation: You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes: We may change subscription pricing with 30 days notice. Price changes apply to renewals after the notice period.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy or reliability of any information obtained through the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIB AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or your personal information
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or omissions in any content
  • Loss or damage to cryptocurrency assets

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless GIB and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account and access to the Service at any time, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through your account settings. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for violations of intellectual property rights.

14. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and GIB regarding the Service and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
